Member Bylaws
Living by these rules is the foundation of what our clan represents among one another as well as to the world. Adhering to these rules is what legitimizes OHC as an actual selective group, joined together for our collective best interest and in support of one another as a brotherhood. Furthermore, these bylaws establish a well-defined guideline for the commitment of which each member can hold themselves and their fellow members accountable.
If a member breaks these bylaws, the clan will deal with that member accordingly. If these bylaws are broken, the punishment for that discrepancy could result in suspension from the clan, immediate expulsion from the clan or worse, as deemed necessary and voted on by the clan.
General:
1. Members will always put fellow clan members before themselves.
2. Members will never leave a fellow member to fall into the hands of the enemy and under no circumstances dishonor the clan.
3. Members must remain loyal to the clan at all times.
4. Members must attend no less than (2) of their official Tribe functions as well as no less than (1) mandatory Clan Gathering per year. These mandatory gatherings are:
· OHC Spring Gathering, hosted by the TX Tribe the last weekend of March
· OHC Summer Gathering, hosted by the CO Tribe the third weekend of July
5. Additional clan sponsored rides, hunts and other gatherings will be voted on by the hosting tribe.
6. Loose lips sink ships…there is absolutely no talking about clan business to persons outside the clan.
7. Members must wear their rings when with other members.
8. A member may not belong to any other clan or like organization.
9. If a group or individual attacks or otherwise wrongs any member, the whole clan shall stand in support of that wronged member and fight for that member, as required. If, however, the member is drunk or otherwise impaired and unduly aggressive in the pursuit of an altercation, the rest of the members may escort him away or intercede before the situation escalates to violence.
Dues:
10. Members must pay $500.00 for annual dues, required NLT February 1st of the given year. The record for all dues collected and expenditures will be made available to any member upon request.
11. Dues will be deposited and maintained in the OHC Holdings LLC account, with balances and expenditure explanations available upon a member’s request.
a. A. Carter is appointed as Treasurer of OHC Holdings LLC, a TX Limited Liability Company.
i. A. Carter will have full access to this account.
b. B. Slaughter is the Trustee for OHC Holdings LLC, a TX Limited Liability Company.
i. B. Slaughter will have full access to this account.
12. Dues will be used to pay for sponsored gatherings, operations, equipment and the support of individual clan members as voted on by the clan.
13. All expenditures will require a majority member vote by:
a. Clan for budgets
b. Tribes for individual purchases and procedures
c. Board of Directors for OHC Holdings LLC
14. Budgets will be established to fund:
a. Both mandatory Clan Gatherings
b. Reserve Fund
c. Tribe Allotments
d. OHC Holdings LLC dba Efforts
15. Any member spending OHC funds will follow all transaction documentation requirements, as defined by OHC Holdings LLC.
Votes:
16. Every member must vote on each issue pertaining to the clan.
17. A unanimous vote is required for:
a. The entry of a prospect member as a permeant member to the clan.
b. The punishment of a clan member.
c. The expulsion of a member from the clan.
18. A majority vote is required for:
a. The entry of an individual as a prospect member to the clan.
b. The amendment of clan bylaws and other regulations, requirements or rules.
c. Any additional clan decisions.
19. No member will go against anything the clan has voted for and passed.
Prospects:
20. Members of the clan are encouraged to remain observant for likeminded and uniquely talented individuals that may become qualified as sponsored prospective members of the clan [a Prospect] for the purpose of growing the clan’s influence and abilities.
21. A member must have no less than (2) two years in the clan before sponsoring a prospect.
22. A member my sponsor up to and no more than (2) two prospects at any time.
23. A prospecting member must participate as a Prospect for no less than (1) year from the date they were voted in as a prospect.
24. The sponsoring member is ultimately responsible to the clan for each of their prospect’s actions.
Respect:
25. No member will purposely destroy clan property.
26. If a member unintentionally damages or destroys clan property, that member will immediately replace the effected property to the satisfaction of the clan.
27. No member will purposely destroy the property another clan member.
28. If a member unintentionally damages or destroys another clan member’s property, that member will immediately replace the effected property to the satisfaction of the effected member.
29. No outstanding debts may exist between members. All applicable loan payments and other debts must be current.
30. No member may ever refuse to help another member.
31. Members will always stay together on rides, runs, parties, events, hunts, etc. and will not fraternize with rival clans, groups or individuals.
32. Members should not fight each other under any circumstances. All disputes must be rectified through nonviolent means between the disputing members or by the majority vote of the clan.
33. If a member is told they are too drunk to drive, that member will turn over their keys to another member. They and their vehicle will be taken care of by the clan.
34. Respect is to be shown to all clan members, as well as their bikes, wives, girlfriends, family members, houses, property, job, etc.
35. Members are responsible for their wives, girlfriends, family members and external friends.
36. Members must respect their ring, patch and all additional clan branded property; don't let anyone take them from you.
37. Only another member or the family of a member can “hold” a member’s ring or patch, when applicable.
38. If a member should fall, the remaining members will provide support to the fallen member’s family and ensure that the member’s legendary memory lives on among their children.
39. If a member’s ring or patch is lost or stolen, that member will be judged by the remaining members. Every reasonable effort will be made by the clan to recover our missing property.
40. If a member leaves clan, the former member must immediately turn over their ring, patch and all addition clan branded property to a member in good standing. In addition, if that individual has any OHC ink, that ink must be blacked out, tattooed over or removed from their body. Otherwise, every reasonable effort will be made by the clan to recover our missing property and remove our crest.
Patch Holders:
41. Patch Holders must have a street legal, serviceable motorcycle and the applicable gear to participate in local rides, interstate runs and other motorcycle centered events.
a. **H. Chase is the exception to this bylaw, designated as the “honorary Viking” to roll with and support Patch Holder rides as Road Crew.
42. Patch Holders must wear their cuts when ridding with other members, unless authorized for a specific event by unanimous Patch Holder members vote.
43. Patch Holders must ride no less than 1000 miles per year.**
44. In addition to the mandatory attendance requirements of Bylaw 4, Patch Holders must attend the annual Patch Holders gathering as well as regularly participate in additional OHC organized rides.
a. Patch Holder may be excused from an annual Patch Holders Gathering by a unanimous Patch Holder members vote.
Members Not In Good Standing:
45. Member Not In Good Standing (MNIGS) indicates that the member has failed to:
a. Meet attendance requirements and has likewise been voted to be Unexcused from a mandatory gathering,
and/or
b. Pay their dues, as required.
46. Any member designated as a Member Not In Good Standing may rectify the situation by simply:
a. Meeting the minimum requirement of attending at least one mandatory gathering per year and otherwise remain engaged as an active member of their tribe,
and/or
b. Staying current on their dues.
Members On Suspension:
47. Members voted to be a Member Not In Good Standing for two consecutive mandatory gatherings will be placed On Suspension and their member access / benefits will be withheld until rectification.
48. Members with an On Suspension status my be expelled from the clan by majority vote at the next mandatory gathering. (This is an exception to Bylaw 17.c.)
